@whatareyoushippingon X, you're asking us to extract the contents of your tweet (and limited public profile info) and publish a project listing about it. You keep ownership of your content. We can remove listings at our discretion. The Service is provided "as is" with no warranty. Disputes are resolved by binding arbitration in Delaware unless you opt out within 30 days. This summary isn't a substitute for the full Terms below.These Terms of Service (the “Terms”) are a binding legal agreement between you and Dynamic Alpha LLC, a Delaware limited liability company (“Dynamic Alpha,” “we,” “us,” or “our”), and govern your access to and use of whatareyoushipping.com, our X account @whatareyoushipping, and any related products, APIs, content, or services we make available (collectively, the “Service”).
By accessing the Service, mentioning @whatareyoushipping on X, or otherwise submitting content for listing, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of these Terms
You agree to these Terms by (a) browsing or otherwise accessing the Service, (b) mentioning @whatareyoushippingon X with the apparent intent to submit a build, or (c) clicking, tapping, or otherwise affirmatively indicating acceptance where presented. If you accept these Terms on behalf of a company or other entity, you represent that you have authority to bind that entity, in which case “you” refers to that entity.
2. What the Service is
The Service is a public directory of software projects, products, and other “builds.” When a person mentions @whatareyoushippingon X, our automated systems read the tweet thread and reasonably-related public profile signals, extract project metadata (name, URL, category, tagline, pricing, and similar attributes), and publish a server-rendered listing on whatareyoushipping.com that may include a hyperlink to the submitter's project. Listings are intended to be publicly indexable by search engines and may carry a dofollow link attribute.
The Service is currently provided free of charge. We may introduce paid features in the future; if we do, those features will be subject to additional terms presented at the time of purchase.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction to consent to digital services without parental permission) to use the Service. By using the Service, you represent and warrant that (a) you meet the age requirement, (b) you have not been previously suspended or banned by us, and (c) your use of the Service does not violate any law applicable to you.
The Service is offered from the United States. If you access it from outside the United States, you are responsible for compliance with local law.
4. Accounts and Identity
The Service does not require you to create an account on whatareyoushipping.com. Your identity on the Service is derived from your public X account at the time of submission. You are responsible for the security of your X account and for all activity originating from it. If your X account is suspended, transferred, or compromised, contact us at the address below; we may, but are not obligated to, update or remove related listings.
We may, in the future, offer optional verified-builder accounts. Any such account will be subject to additional terms presented at sign-up.
5. Submissions via X
When you mention @whatareyoushippingon X with the apparent intent to submit a project (a “Submission”), you understand and agree that:
- The Submission, the X thread context, and public information on the submitting X profile may be ingested by our automated systems, including large language models, to extract metadata.
- We may publish a listing derived from the Submission on the Service, including the text of your tweet, your X handle and display name, your project name and URL, and a link to the original tweet.
- Listings are public, indexable by search engines, and may be archived by third parties (such as the Internet Archive) outside our control.
- Submitting a third party's project without their authorization is prohibited (see Section 8).
You may request that a listing about your project be removed at any time; see Section 7.
6. License you grant us
You retain all ownership of the content you submit. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, reproduce, store, cache, display, perform, distribute, translate, reformat, and create derivative works of (a) your public tweets and replies that mention @whatareyoushipping, (b) the public profile information associated with such tweets, and (c) any other content you voluntarily submit to the Service, in each case solely for the purpose of operating, providing, improving, and promoting the Service.
This license is granted for the duration of the listing's availability on the Service and continues after removal only to the extent necessary for backup, audit, fraud-prevention, and legal-compliance purposes.
You represent and warrant that you have all rights necessary to grant this license and that your content does not infringe or violate any third-party rights or applicable law.
7. Listing edits, claims, and removal
We may, in our sole discretion and at any time, edit, decline to publish, remove, or refuse to re-publish any listing for any reason or no reason. Reasons we are likely to remove a listing include but are not limited to: a violation of these Terms; a credible complaint from the project owner or a rights-holder; misleading or deceptive content; SEO manipulation; or our determination that the listing harms the Service or its users.
If you are the owner of a project listed without your consent, or you want a listing about your project removed or corrected, email legal@dynamicalpha.com from a domain you control or include verification (such as a tweet from the X account that authored the original Submission). We will review removal requests in a commercially reasonable timeframe.
8. Acceptable use
You agree that you will not, and will not attempt to:
- Submit content about a project that is not yours without explicit authorization from the project owner.
- Use the Service for unlawful, fraudulent, deceptive, defamatory, harassing, hateful, or infringing activity.
- Submit links to malware, phishing, illegal goods or services, CSAM, sexual content involving real persons without consent, promotion of violence or terrorism, or content prohibited by applicable law.
- Spam, bulk-submit, or use automation to overwhelm the Service or manipulate its rankings, feeds, or search visibility.
- Probe, scan, or test the vulnerability of the Service; bypass any access controls or rate limits; or interfere with normal operation.
- Scrape, crawl, harvest, or extract data from the Service using automated means, except by well-behaved search-engine indexers following our
robots.txt. - Use the Service or its content to train a machine-learning model without our prior written consent.
- Misrepresent your identity, your project, or your affiliation with any person or entity.
- Reverse engineer, decompile, or attempt to discover the source code or underlying ideas of the Service except to the limited extent permitted by law.
- Use the Service to violate the rights of any third party.
We may investigate and respond to suspected violations, including by removing content and cooperating with law enforcement.
9. AI-generated content
Listings are produced with the assistance of large language models and other automated systems. We do not guarantee that any AI-extracted field — including project name, URL, category, pricing, or summary — is accurate, complete, or current. You are responsible for reviewing any listing about a project you control and requesting corrections under Section 7. We may rely on the information present in your public tweet and X profile as authoritative for the purpose of generating the listing.
10. Third-party services and links
The Service interacts with and links to third-party platforms, including without limitation X (X Corp.), Anthropic, hosting and infrastructure providers, and the websites of the projects we list. We do not control those third parties and are not responsible for their content, policies, availability, or practices. Your use of any third-party service is governed by the agreements you have with that third party. The Service is not affiliated with, endorsed by, or sponsored by X Corp.
11. Our intellectual property
The Service, including its software, design, brand, name, logos, and the compilation and arrangement of listings, is owned by Dynamic Alpha LLC and is protected by intellectual-property and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes, subject to these Terms. All rights not expressly granted are reserved.
“whatareyoushipping” and our logos are trademarks of Dynamic Alpha LLC. You may not use them without our prior written permission, except for nominative fair use to refer to the Service.
12. Copyright complaints (DMCA)
We respect the intellectual-property rights of others and respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (the “DMCA”). If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes:
- A physical or electronic signature of the owner or authorized agent of the owner of the exclusive right being infringed;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the material claimed to be infringing and information reasonably sufficient to locate it on the Service (such as the listing URL);
- Your contact information (name, address, telephone, email);
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner.

We may, in appropriate circumstances, terminate the privileges of users who are repeat infringers. Misrepresentations in a DMCA notice may subject you to liability under 17 U.S.C. § 512(f).
13. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to that handling.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, DYNAMIC ALPHA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY LISTING, BACKLINK, OR EXTRACTED METADATA WILL BE ACCURATE, COMPLETE, OR CURRENT. SEARCH-ENGINE INDEXING, RANKING, AND BACKLINK ATTRIBUTION ARE CONTROLLED BY THIRD PARTIES AND ARE NOT GUARANTEED.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DYNAMIC ALPHA OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE AMOUNTS YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
16. Indemnification
You will defend, indemnify, and hold harmless Dynamic Alpha and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the Service, (b) your Submissions or other content, (c) your violation of these Terms, or (d) your violation of any third-party right. We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with our defense.
17. Termination
We may suspend or terminate your access to the Service, remove your Submissions, or refuse future Submissions, at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 6, 10, 11, 14–16, 20–23) will survive.
18. Changes to the Service
We may add, modify, suspend, or discontinue any aspect of the Service at any time, including listings, features, categories, and URLs. We will use reasonable efforts to avoid breaking permanent backlinks but do not guarantee that any specific listing URL will remain available.
19. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will provide notice by posting the updated Terms on the Service with a new “Last updated” date, and, where reasonable, by additional means. Material changes take effect when posted, unless we state otherwise. Your continued use of the Service after a change takes effect constitutes acceptance.
20. Governing law and venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Subject to the arbitration provision below, the state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction over any non-arbitrable dispute, and you and we each consent to personal jurisdiction and venue there.
21. Disputes and arbitration
Please read this section carefully.Except for disputes that qualify for small-claims court and except for claims of infringement or misappropriation of our intellectual property rights, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a “Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in English, in New Castle County, Delaware (or by video/telephone at your election), before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Informal resolution. Before initiating arbitration, you agree to first attempt to resolve the Dispute informally by sending a written notice to legal@dynamicalpha.com describing the Dispute and the relief you seek. If we cannot resolve the Dispute within 60 days, either party may initiate arbitration.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to legal@dynamicalpha.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out.” Your notice must include your name, your X handle (if any), and a clear statement that you want to opt out. Opting out will not affect any other part of these Terms.
22. Class action waiver
YOU AND DYNAMIC ALPHA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. IF THIS CLASS-WAIVER IS FOUND UNENFORCEABLE, THEN THE ENTIRETY OF THE ARBITRATION SECTION WILL BE NULL AND VOID AS TO THE PARTIES, BUT THE REMAINING TERMS WILL REMAIN IN EFFECT.
23. Miscellaneous
Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and Dynamic Alpha regarding the Service and supersede all prior or contemporaneous agreements on that subject.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be replaced by an enforceable one that most closely reflects the original intent.
No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms or your rights under them, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely, including to an affiliate or in connection with a merger, acquisition, or sale of assets.
Force majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications outages, or third-party provider failures.
Relationship of the parties
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and us.

We may give notice to you by email, by posting on the Service, or by other reasonable means. You may give notice to us at the contact details below.
U.S. export controls and sanctions
You represent that you are not located in, under the control of, or a national or resident of any country subject to comprehensive U.S. sanctions, and that you are not on any U.S. government list of prohibited or restricted parties. You will not use the Service in violation of U.S. export-control or sanctions laws.
